Terms of Use
These Terms of Use ("Terms") govern your use of Cardero and its related website and services. Cardero is operated by SubSky, LLC ("we", "us"), a Delaware limited liability company, 131 Continental Dr, Suite 305, Newark, DE 19713, United States.
By downloading or using Cardero, you agree to these Terms. If you do not agree, please do not use Cardero.
1. Definitions

Cardero or the App: the Cardero mobile app.

Service: the App, the cardero.me website, and the scanning, values, history and collections that run on our servers.

Estimate: a value in US dollars that Cardero shows for a card.

You: the person using Cardero.
2. Who may use Cardero
You must be at least 13 years old, or older if the law where you live sets a higher age for using online services without a parent's consent. If you are under 18, you may use Cardero only with the permission of a parent or guardian.
3. Your account and deleting it

Cardero signs you in anonymously the first time you open it. The account has no name, email or password. Your scans and collections are stored with it on our servers.

Anyone who uses Cardero on your phone uses your account. Deleting the app can lose access to your scans, and a new phone starts with a new account. We cannot recover a lost account.

Deleting your account. Go to Settings → Delete account. Your account is closed at once, and this app starts fresh with a new anonymous account. Your earlier scans and collections are no longer shown in the app. Deleting your account does not erase everything:

photos and scan records are kept, without any link to you;
-
your IP address, stored only in hashed form, is unlinked from them;
-
backups made before you delete keep the old link until they expire (up to 12 months).
The new account may not include free scans.

Deleting the app or your account does not cancel a subscription. See section 8.
4. Privacy
Our Privacy Policy (https://cardero.me/privacy) explains what we collect, why, and how long we keep it. The App shows no ads and contains no advertising or analytics SDKs.
5. License and intellectual property

If you download Cardero from the App Store, the app is licensed to you under Apple's Standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). These Terms add the rules for the Service. If the two conflict about the license to the app, Apple's agreement applies.

Subject to these Terms, we give you a personal, non-exclusive, non-transferable and revocable license to use Cardero for lawful, personal purposes.

We and our licensors own Cardero's software, design and text. Card names, artwork and trademarks belong to their owners. Cardero is not affiliated with, sponsored or endorsed by any card maker, game company, league or team whose cards it identifies.

You may not sell, rent, lend or redistribute the App, or remove any copyright or other proprietary notice from it.
6. Your photos

You keep your rights in your photos.

You allow us to store and process them, and to send them to the processors named in our Privacy Policy, to provide and secure the Service. This permission lasts as long as we keep them.

We keep photos and scan records indefinitely, including after you delete your account. Backups of our database are kept for up to 12 months.

Your photos are not shared with other users. Cardero has no public profiles or posts.

Photograph cards, not people. Send only photos that you have the right to share with us.
7. Identification and values

Cardero uses automated analysis, including AI, to identify cards and estimate values. Results can be wrong or incomplete. When a match is uncertain, the app asks you to check it.

An AI model makes each estimate from the card's identity and the condition read from your photo. An estimate is not an appraisal, an offer to buy, a record of a sale, or financial or investment advice. Some cards have no estimate, and estimates saved in your collection are not updated automatically.

Cardero does not grade cards. On a graded slab, it does not check the grade on the label.

If a card matters to you, for example because it is valuable or you plan to buy, sell, grade or insure it, check it against other sources or ask a qualified person.
8. Subscriptions, payments and refunds

Billing: a subscription starts when payment is confirmed and renews automatically until you cancel it. App Store subscriptions are billed by Apple and canceled in iPhone Settings; subscriptions bought on our website are billed by us.

Refunds: see our Refund & Cancellation Policy (https://cardero.me/refunds). For App Store purchases, Apple's refund policies apply.

Deleting the app or your Cardero account does not cancel a subscription.

Nothing in these Terms takes away refund or cancellation rights you have under the consumer law where you live.
9. Updates and other websites

We may add, change or remove features, or stop the Service.

The "Listings" section opens searches on third-party shopping sites, such as eBay and TCGplayer. Those pages are not records of sales. We do not control those sites or their sellers, and their own terms apply.
10. Prohibited uses
You agree not to:

use Cardero for anything unlawful, or send unlawful content or photos meant to show people rather than cards;
-
use several accounts, scripts or other automation to get more free scans;
-
try to gain unauthorized access to the Service, or get around its limits or security checks;
-
interfere with, overload, attack or scrape the Service;
-
copy, modify or reverse-engineer the App beyond what the law allows;
-
share, resell or transfer paid access, or use someone else's payment method without permission;
-
file a payment dispute you know to be false instead of contacting us.
To prevent abuse, the Service limits how often it can be used, and a new account may not include free scans.
11. Price errors
A price can be shown wrongly by mistake on our website or in the app. The price that applies is the one Apple shows before you confirm an in-app purchase, or the one shown at checkout when you pay on the web.
12. Copyright notices
If you believe that something in Cardero or on our website infringes your copyright, email support@cardero.me with:

your physical or electronic signature;

the work, the material you believe infringes it, and where that material appears;

your contact details;
-
a statement that you believe in good faith that the use is not authorized;

a statement, under penalty of perjury, that your notice is accurate and that you own the copyright or may act for its owner.
13. Warranties and liability

We aim to keep the Service available, but we cannot promise that it will never be interrupted.

Except where the law says otherwise, Cardero is provided "as is" and "as available", and we give no implied warranties of merchantability, fitness for a particular purpose or non-infringement.

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data, or for losses from decisions you make based on an identification or an estimate.

Where liability can lawfully be limited, our total liability to you for all claims relating to Cardero is limited to the greater of US$50 and the amount you paid us for Cardero in the twelve months before the event that gave rise to the claim.

Nothing in these Terms limits or excludes our liability for fraud, for fraudulent misrepresentation, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be limited. Where your local law does not allow these exclusions or limits, they do not apply to you, and the rest of this section still stands.
14. Indemnification
To the extent the law allows, you agree to indemnify us and our employees against claims, losses and costs, including reasonable legal fees, that arise from your breach of these Terms or your unlawful use of Cardero.
15. Ending these Terms
You can stop using Cardero at any time and delete your account in the app. We may suspend or end your access if you break these Terms, or if the law requires it. If we end a subscription bought on our website without you being at fault, we refund the unused part of the period you paid for. Sections that by their nature should survive, including sections 13, 14 and 16, survive the end of these Terms.
16. Governing law, disputes and severability

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute we cannot resolve between us may be brought in the state or federal courts located in Delaware.

Your local rights. If you are a consumer, this does not deprive you of the protection of mandatory consumer law in the country or state where you live, and it does not stop you from bringing a claim in your local courts where the law gives you that right. You may also bring an eligible claim in small claims court.

If any part of these Terms turns out to be unenforceable, the rest still applies. If we do not enforce a term straight away, we have not given up the right to enforce it later. These Terms are written in English, and the English version governs.
17. Changes to these Terms
We may update these Terms. We will post changes here and update the effective date. Material changes are posted before they take effect, and no change applies retroactively. If you keep using Cardero after a change takes effect, the new Terms apply.
